These Terms of Service (“Terms”) govern your access to and use of the websites and services operated by jchowlabs, LLC (“Company,” “we,” “us,” or “our”), including:

(collectively, the “Sites”), including all content, features, lab environments, and interactive tools made available through the Sites.

By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, do not use the Sites.

1. About jchowlabs

jchowlabs, LLC is a California single-member limited liability company providing AI, security, and technology advisory services. The Sites serve as an educational and demonstration platform, allowing visitors to explore identity security concepts, authentication technologies, and related advisory capabilities.

The lab environments on the Sites are provided for educational and demonstration purposes only. They are not production systems, and no reliance should be placed on lab outputs for any operational, legal, or security decision.

2. Eligibility

You must be at least 18 years of age to access or use the Sites or any lab environment.

By using the Sites, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a binding agreement.
  • Your use of the Sites complies with all laws and regulations applicable in your jurisdiction.

We reserve the right to terminate access for any user we have reason to believe does not meet these requirements.

3. Scope of Services

A. Informational Content

The Sites provide articles, writeups, and advisory content related to AI, identity security, and technology. This content is provided for general informational and educational purposes only and does not constitute professional, legal, security, or technical advice.

B. Lab Environments

Certain areas of the Sites allow registered users to interact with demonstration security and authentication flows, including passkey-based login, facial recognition authentication, and related identity technologies.

Lab environments:

  • Are experimental and educational in nature
  • May be modified, suspended, or discontinued at any time without notice
  • Are not intended to simulate or replace production security systems
  • Should not be used to store, transmit, or process sensitive personal, financial, or confidential information beyond what is expressly described in our Privacy Policy

C. Voice Concierge

The Sites include an optional AI-powered voice concierge feature to assist with site navigation. Use of the voice concierge is subject to your consent as described in our Privacy Policy. The voice concierge is an automated tool and does not constitute professional advice of any kind.

4. Account Registration

Access to the lab environment is by invitation only. Lab accounts are created directly by jchowlabs, LLC following an operator review process. There is no self-service account registration. By accepting an invitation and accessing the lab environment, you agree to:

  • Provide accurate information when requested during the vetting process
  • Maintain the security of any account credentials provided to you
  • Not share your account credentials with any other person
  • Use the lab environment solely for the evaluation and educational purposes for which access was granted
  • Notify us promptly at privacy@jchowlabs.com if you suspect unauthorized access to your account

You are solely responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorized use of your account resulting from your failure to maintain credential security.

Lab accounts and associated data are deleted promptly upon completion of your evaluation period, and on a rolling 7-day deletion cycle at maximum.

5. Prohibited Conduct

By using the Sites and lab environments, you agree that you will not:

General Prohibitions

  • Use the Sites for any unlawful purpose or in violation of any applicable law or regulation
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Transmit any content that is harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Interfere with or disrupt the operation of the Sites or any connected infrastructure

Lab-Specific Prohibitions

  • Attempt to gain unauthorized access to any account, system, or data other than your own
  • Attempt to probe, scan, exploit, or test the vulnerability of the Sites, lab infrastructure, or any connected systems without our express written authorization
  • Attempt to extract, harvest, or access data belonging to other users
  • Use automated scripts, bots, crawlers, or similar tools to access or interact with the Sites or lab environments
  • Share your lab account credentials with any other person
  • Use the labs for any commercial purpose, including reproducing lab flows or architectures for deployment in a commercial product or service, without our express written consent
  • Enroll biometric data belonging to any person other than yourself
  • Submit false, synthetic, or third-party facial data during biometric enrollment

Content and IP Prohibitions

  • Reproduce, republish, or redistribute original written content, articles, or advisory materials from the Sites without attribution and express written permission
  • Use jchowlabs branding, name, or marks in any way that implies endorsement or affiliation without our written consent

We reserve the right to determine, in our sole discretion, what constitutes a violation of these Terms.

6. Intellectual Property

All original written content, articles, advisory materials, and branding on the Sites — including the jchowlabs name, logo, and site identity — are the intellectual property of jchowlabs, LLC and are protected by applicable copyright and trademark law.

The lab environments themselves implement common, publicly documented authentication standards and architectures (including WebAuthn and FIDO2) and we make no proprietary claim over those underlying technologies or patterns.

You are granted a limited, non-exclusive, non-transferable license to access and use the Sites for their intended educational and evaluation purposes. This license does not include the right to reproduce, distribute, or create derivative works from the Sites’ original content without our express written permission.

7. Disclaimer of Warranties

THE SITES, CONTENT, AND LAB ENVIRONMENTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JCHOWLABS, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WARRANTIES THAT THE SITES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS
  • WARRANTIES AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR LAB OUTPUT

Lab environments are experimental demonstrations. They are not certified security systems, and no output from any lab should be interpreted as a security assessment, certification, or professional recommendation.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

JCHOWLABS, LLC, ITS MEMBERS, OFFICERS, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising out of or related to your use of or inability to use the Sites, including but not limited to loss of data, unauthorized access to your data by third parties, or reliance on any content or lab output.

IN NO EVENT SHALL JCHOWLABS, LLC’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITES EXCEED FIVE HUNDRED DOLLARS ($500), regardless of the form of action or the basis of the claim.

These limitations apply whether or not jchowlabs, LLC has been advised of the possibility of such damages, and to the maximum extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Nothing in this section limits our liability for fraud, willful misconduct, or gross negligence.

9. Indemnification

You agree to indemnify, defend, and hold harmless jchowlabs, LLC and its members, officers, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Sites or lab environments
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your unauthorized access to or extraction of other users’ data
  • Any biometric data you submit that belongs to a third party without their consent

10. Account Termination and Suspension

We reserve the right to suspend or terminate your access to the Sites or any lab environment, with or without notice, if we reasonably believe you have:

  • Violated these Terms
  • Engaged in conduct that poses a security risk to the Sites, lab infrastructure, or other users
  • Provided false information during registration or biometric enrollment
  • Attempted unauthorized access to systems or data

Where practical and where doing so does not compromise security or the integrity of an investigation, we will attempt to notify you of a termination. We are not obligated to provide notice before acting when a security risk is present.

Termination does not affect any rights or obligations that arose before termination, including our data deletion obligations under the Privacy Policy.

11. Third-Party Services

The Sites integrate with third-party service providers including Amazon Web Services, AWS Rekognition, ElevenLabs, and Google Analytics. Your interactions with these services may be subject to their own terms and privacy policies.

We are not responsible for the practices, content, or availability of any third-party service. Links to third-party sites or services do not constitute our endorsement of those sites or services.

12. Changes to These Terms

We may update these Terms periodically. Updates will be posted with a revised effective date.

For non-material changes, continued use of the Sites following the updated effective date constitutes your acceptance of the revised Terms.

For material changes — including changes to the limitation of liability, prohibited conduct, or biometric data handling — we will provide reasonable advance notice. Where required by applicable law, we will seek fresh consent before material changes take effect.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

A. Informal Resolution First

Before initiating any arbitration or legal proceeding, you agree to contact us at privacy@jchowlabs.com with a written description of your dispute and the relief you seek, and give us 30 days to attempt to resolve it informally. This requirement does not apply if you are seeking emergency injunctive relief. We agree to the same obligation before initiating any claim against you.

B. Binding Arbitration

If a dispute cannot be resolved informally, you and jchowlabs, LLC agree to resolve it through final and binding arbitration rather than in court, except as provided in Section 13C below.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration will be conducted in California, or by telephone or video at either party’s election. The arbitrator shall apply California law. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

This arbitration agreement is mutual. jchowlabs, LLC also agrees to resolve disputes with you through arbitration rather than court, on the same terms.

For claims under $10,000, you may choose whether the arbitration proceeds by telephone, video, written submissions, or in person. For claims under $25,000, AAA’s Expedited Procedures apply.

Your share of arbitration fees will not exceed $200 for consumer claims under AAA’s Consumer Arbitration Rules. We will cover any remaining AAA administrative fees.

C. Small Claims Court Carve-Out

Either party may bring an individual claim in small claims court in California instead of arbitration, provided the claim qualifies for small claims court and remains an individual claim.

D. Class Action Waiver

YOU AND JCHOWLABS, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person’s claims and may not preside over any class or representative proceeding. If this class action waiver is found unenforceable for any reason, the entire arbitration agreement in Section 13B shall be null and void, and the dispute shall be resolved in court under Section 13E.

E. Courts for Non-Arbitrable Claims

For any claim that is not subject to arbitration under these Terms — including disputes about the validity or scope of the arbitration agreement itself — you consent to the exclusive jurisdiction of the state and federal courts located in California.

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.

15. Entire Agreement

These Terms, together with our Privacy Policy and any standalone consent disclosures (including the Biometric Data Consent Disclosure), constitute the entire agreement between you and jchowlabs, LLC regarding your use of the Sites, and supersede any prior agreements or understandings on that subject.
